Jurisdiction:

The Morgan Superior Court No. 2 was created by the Indiana General Assembly in 1992 and began operation on July 1, 1993. The jurisdiction of the Court is identical to the Morgan Circuit Court, in that any type of case (criminal, civil, divorce, juvenile, etc.) may be filed in the Court. By agreement between the Court and Circuit Court, and to facilitate the management of a growing caseload in juvenile cases, all juvenile delinquency cases are filed in Superior Court 2, and all Children in Need of Services and Paternity cases are filed in Circuit Court.

The Morgan Superior Court No. 2 is a court "of record," as are the Morgan Circuit Court, the Morgan Superior Court No. 1 and the Morgan Superior Court No. 3. All proceedings in Court are recorded and the recordings maintained for transcription. All judgments from a court of record may be directly appealed to the Indiana Court of Appeals or the Indiana Supreme Court.

The Morgan Superior Court No. 2 is staffed by: the Judge, a Court Reporter, a Court Bailiff. The Court Reporter is responsible for the recording and transcription of all cases heard in court, preparing and maintaining the written record of all proceedings, orders and judgments issued, and the scheduling of cases to be heard each day. The Bailiff is responsible for organizing and managing the jury venire for all Jury Trials conducted by the Court, receiving and entering in the record all new cases, pleadings and motions filed with the Court by litigants, and responding to inquiries by litigants, attorneys, jurors and the public.


Superior Court No. 2: Case Filing and Disposition Statistics:

Between July 1, 1993 (when the Court began operation) and March 31, 2008 (the end of the latest reporting period), a total of 13924 new cases were filed in the Court, and 13330 cases were completed and closed. Cases are completed and closed by: Judgments issued after a Court or Jury Trial, agreed settlements, guilty pleas, dismissals, default judgments.

These figures include only new cases filed and closed (for the first time) during this period, but do not count cases redocketed (reactivated) and pending for post-dispositional matters such as: post-dissolution issues (e.g., child support enforcement, modification), probation violation cases, sentence modification requests, post-conviction relief cases, post-judgment proceedings supplemental in civil cases to enforce the judgment, contempt hearings to enforce Court orders. Many cases, especially divorce-related child support, custody and visitation cases, can be (and frequently are) reactivated many times over the course of several years.
